MCLE - Completing the Requirements

The following information will help if your MCLE reporting period ended and you still need additional credits. If you still have any questions about your MCLE compliance, please contact the MCLE Department at (208) 334-4500.

Requesting an Extension

You can receive an extension from January 1 until March 1 to complete your MCLE requirements by indicating it on your license fee notice and paying the $100 MCLE extension fee or by submitting a written request (a simple letter) and paying extension fee.  All the credits from courses taken to complete your MCLE requirements will be counted on your previous reporting period.  The final licensing deadline is March 1.

If you have applications pending for courses taken before December 31, you do not have to pay for an extension.  The extension request and fee is required only if you take courses in January/February to complete previous reporting period’s requirements.  Until the courses are approved, keep your MCLE certificate of compliance.  You may submit the rest of your licensing without it.  Simply include a note stating you are waiting for credit approval and will submit the certificate of compliance later.  Send the certificate when all the courses have been approved.

Note:  If you request a MCLE extension, the rest of your licensing must still be physically received in the Idaho State Bar office by February 1 licensing deadline to avoid the licensing late fee.  Do not submit your MCLE certificate of compliance until you completed the requirements.  You may submit the rest of your licensing without it and send the certificate when you are done.

Updated Attendance Records

You can check your current Mandatory Continuing Legal Education (MCLE) Attendance Records online.  The website records are updated weekly.

The attendance records are based on the course providers’ verification of your attendance.  Not all provider submit attendance information, but this does not create a problem.  Your attendance does not have to be verified by the provider for you to get credit for a course.  The course must be approved for Idaho MCLE, but it does not have to be on your attendance credit report.  Simply add any additional, approved courses to your MCLE certificate of compliance included in your licensing packet (mailed in mid-November).

Course Accreditation

All courses on your certificate of compliance must be approved for mandatory continuing legal education (MCLE) credit by the Idaho State Bar.  If you are not sure whether or not a course has been approved, use the Approved Courses Search page to check the list of approved courses. Do not assume that courses held outside of Idaho have been approved for Idaho MCLE credit and do not assume that approval in another state means the course is approved in Idaho.

If the course you attended is not approved, apply for accreditation immediately.  Complete and submit the appropriate application form:

Applications must be accompanied by a complete course schedule.  The schedule must include a description of the legal education topics covered in the course and a full time breakdown.  Expect the processing time to be at least 3-4 weeks.

Do not submit your MCLE certificate of compliance until all the courses listed have been approved for Idaho MCLE credit.  You may submit the rest of your licensing without it.  Simply include a note stating you are waiting for credit approval and will submit the certificate of compliance later.  Send the certificate when all the courses have been approved.

Self-Study Credit

You may obtain to 15 credits through self-study during your reporting period.  Self-study can be through online programs, video/audio disks or other media.  If you are nearing the end of your reporting period or extension period, you should consider pre-approved self-study courses to avoid application processing delays.  The Idaho State Bar and Idaho Law Foundation have pre-approved Online Courses available.

Note: Watching a DVD or listensing to a CD with another attorney is still considered self-study. Idaho Bar Commission Rule 404(a)(3)(C) states: a CLE activity will be deemed a self-study program unless: three (3) or more participants attend the CLE activity and the participants have access to the presenter during the CLE activity or, in the case of a video, audio or other recording, a moderator is present during the CLE activity who is qualified to answer attendees' questions about the CLE topic.

Note:  Do not take an online course if you already completed the course.  You cannot get credit for the same course multiple times.  If you took a course in another format (live, rental, online, etc.), you cannot take it again for MCLE credit.
